1. Introduction and Who We Are

These terms and conditions govern the sale of products by Rare Souvenirs (“we”, “us”, “our”) to you via RareSouvenirs.com. By placing an order, you agree to be bound by these terms. We are a business based in Scotland, UK.

2. Order Acceptance

  • The Contract: When you place an order, you are making an offer to buy. A contract is only formed when we send you an Order Confirmation email.
  • Right to Refuse: We reserve the right to reject any order for any reason (e.g., stock unavailability, pricing errors, or inability to deliver to your UK location). If we reject an order after payment, we will refund you in full.

3. Pricing and Payment

  • Currency: All prices are in Pounds Sterling (£/GBP).
  • Taxes: Prices include VAT where applicable. As a small business, if we are not VAT registered, the price shown is the total price you pay.
  • Payment: We accept Stripe and PayPal. Payment is taken at the time of order.

4. Products and Quality

  • Descriptions: We make every effort to display product details accurately. However, as some items are handcrafted or 3D-printed, minor variations in finish, texture, and colour are to be expected and are not considered defects.
  • 3D Printed Items: Our 3D-printed busts and models are intended for decorative display only. They are not toys and must be kept away from small children and heat sources. Materials (e.g., PLA/Resin) may deform if exposed to high temperatures or direct sunlight.
  • Limited Editions: Items sold as “Limited Edition” or with a certificate of authenticity are subject to availability and cannot be replaced if lost by the customer.

5. Delivery Scope, Timescales & Risk

5.1 Delivery Timescales

  • Standard items (such as T-shirts and magnets) are typically dispatched within 3–5 working days.
  • High-end, made-to-order items, including but not limited to 3D-printed objects, leather-bound items, framed works, or specialist products, are individually manufactured and may take 2–4 weeks to dispatch.

Delivery times are estimates only and may vary due to production requirements, seasonal demand, or carrier delays.

5.2 Delivery Territory & Exclusions

Rare Souvenirs currently delivers exclusively within Great Britain, including Mainland Scotland, England, and Wales. We do not deliver to:

  • Northern Ireland
  • The Channel Islands (Jersey and Guernsey)
  • The Isle of Man
  • The Isles of Scilly
  • British Overseas Territories

Orders placed with delivery addresses outside our supported territory may be cancelled and refunded.


5.3 Shipping Partners & Proof of Delivery

We primarily use Royal Mail, including Tracked 24, Tracked 48, or Special Delivery, depending on the item and service selected.

A carrier status of “Delivered”, including any available GPS data or photographic evidence, will normally be treated as evidence of delivery unless clear contrary evidence is provided.

5.4 Transfer of Risk & Safe Places

Risk of loss or damage passes to you once the item has been delivered to the address provided in your order, or to a location you have expressly designated, such as:

  • A nominated safe place
  • A preferred neighbour

If you authorise delivery to a safe place or third party, Rare Souvenirs is not liable for loss, theft, or damage occurring after delivery to that location.

5.5 Third-Party Collection Points

If you choose delivery to a Royal Mail Local Collect location, parcel shop, locker, or other third-party collection point, risk passes to you once the item is marked by the carrier as “Ready for Collection”.

Any loss, theft, or damage occurring after this point must be resolved by the customer directly with the carrier or collection-point provider.

5.6 Reporting Non-Delivery

If a carrier marks an order as “Delivered” but you believe you have not received it, you should notify us via our contact form within 48 hours of the delivery status update.

Prompt notification allows us to investigate the issue with the carrier.
Delays in reporting may affect our ability to investigate or limit the remedies available, particularly where carrier investigation windows have expired.

6. Cancellation and Returns

  • Standard Goods: You have the right to cancel orders for standard items within 14 days of receipt for a full refund.
  • Exclusions (Made-to-Order): The right to cancel does not apply to items manufactured specifically for your order, including 3D-printed busts and custom leather-bound books.
  • Return Process: To cancel, you must notify us via our contact form. Unless the item is faulty, you are responsible for return shipping costs. Items must be in their original “rare” condition and packaging.

7. Freight Forwarding

We prohibit the use of freight forwarders to bypass shipping restrictions. Our liability ends upon delivery to the UK address provided at checkout. We do not provide export documentation or accept returns for items exported via a third party.

8. Faulty or Damaged Goods

If an item arrives damaged or is not of “satisfactory quality” (Consumer Rights Act 2015), contact us via our contact form within 30 days for a repair, replacement, or refund.

9. Intellectual Property

All designs, 3D models, and content are the property of Rare Souvenirs. Unauthorised commercial use is strictly prohibited.

10. Zero Tolerance: Abuse and Harassment

We have a zero-tolerance policy for verbal abuse, threats, or harassment directed at our staff. We reserve the right to cancel orders and block users who violate this policy. Extreme cases will be reported to Police Scotland.

11. Payments and Chargebacks

You agree to contact us via our contact form to resolve disputes before initiating a chargeback. Fraudulent chargebacks are a breach of contract. We reserve the right to charge a £25 administrative fee for managing disputes and to pursue debts through the Sheriff Court (Small Claims) in Scotland.

12. Governing Law

These terms are governed by Scots Law. Any disputes are subject to the exclusive jurisdiction of the Scottish courts.
